Child Custody

There are two types of custody, Legal Custody and Primary Custody

  • Legal Custody: Legal custody determines who makes the final decisions about major decisions concerning the child including the child’s education, healthcare, extra-curricular activities and religious training. The judge may designate one parent to have sole power to make certain decisions while both parents retain equal rights and responsibilities for other decisions.
  • Physical Custody: Physical custody is about who the child lives with most of the time. When determining child custody the courts use the best interest of the child standard. Therefore, they take a myriad of things into account to determine what is in the child’s best interest.
